# A new citizenship track from the creator of Biden
** Are you an alien in the United States? This route may suit you! **
Very exciting news for American aliens. Yesterday, February 18, 2021, President Biden unveiled new legislation that would create an 8-year citizenship-winning path for the millions of undocumented immigrants in the United States who were brought to the country as children.
While the bill is facing a struggle for aliyah in Congress, it is the beginning of the administration's efforts to create new momentum to push parties on both sides of the aisle to fix our broken immigration system once and for all.
What does the new bill offer?
The new legislation is based on the president's immigration priorities as described during his first day in office.
While President Biden has been in office for less than a month, he is already making progress in his most ambitious effort to date - presenting sustainable immigration proposals to Congress, which will oppose the last four years of harmful policies passed by his predecessor.
In short, the U.S. Citizenship Act of 2021, as is well known, seeks to create (1) an eight-year citizenship track for nearly 11 million undocumented immigrants (2) a shorter legal status process for agricultural workers and recipients of the Childhood Rejection Program, (3) establishes an enforcement plan Which includes the deployment of patrol technology on the southern border.
Earning track for citizenship
Among its provisions, the bill will provide certain undocumented immigrants with a new type of temporary status that will be valid for a period of 5 years and will allow them to apply for citizenship after an additional 3 years. This 8-year proposal represents an improvement over Congress's efforts in 2013 to create an achievable path to citizenship within 13 years.
Exceptions
People with Deferred Child Entry Action (DACA), people eligible for Temporary Protected Status (TPS) from countries suffering from war and natural disasters, and farm workers who can prove they have a work history will be given preference for permanent residence (green card), using fast processing type, provided they Pass background checks and meet other requirements.
This earned route to citizenship will be available only to those who have been in the United States since January 1, 2021. Those who entered the country illegally after that date were not eligible.
Increased funding to reduce the backlog of shelters
If passed, the bill will provide more funding to increase the number of immigration judges and support staffs in order to reduce the extensive visa backlog facing asylum seekers. Advocates have also been offered increased funding to represent unaccompanied minors and other vulnerable groups of immigrants so that they have a chance to get a proper procedure.
$ 4 billion in funding will also be offered to be invested over four years to help fight corruption and improve conditions for immigrants.
The legislation, central to its provisions, seeks to deter Central Americans from making the perilous journey to the United States by establishing refugee processing centers across Central America, where vulnerable immigrants can apply for asylum.
To fight crime in the region and reduce mass migration from Central America, the bill increases resources for deploying international gang mission forces across the region.
Border security
When it comes to border security, the bill proposes to increase security at ports of entry that focus on locating drugs and other types of computers. Criminal penalties for unauthorized immigrants will remain in place, including provisions that impose an admissible threshold for certain criminals, such as those with aggravated offenses.
Special provisions for work visas, bars on inadmissibility, visa quota quotas and visa accrual relief
Interestingly, the bill embodies a provision that would allow counties and municipalities to petition for additional work visas as needed in the local economy. This will allow localities to participate in a way that is absent from previous legislation.
The bill would also end the three-year ten-year admissibility arrangements for undocumented immigrants who voluntarily leave the United States.
Separately, the number of diversity visas issued for countries with low immigration rates to the United States will increase from 55,000 to 80,000. This is great news for countries eligible to participate in the Diversity Visa Lottery Program.
The bill would also reduce the backlog of visas by exempting certain categories from the annual coverage count. For example, spouses, spouses and children under the age of 21 of legal permanent residents will be exempt from the coverages, and will order more visas for the main candidates.
Finally, the bill also proposes removing the word "alien" from the immigration code and replacing it with "non-citizen." The use of the word "alien" has been the subject of much controversy for decades.
What are the chances of the bill in Congress?
While Democrats do not have enough Republican support to pass the bill, it is the start of a series of lengthy debates by politicians, in which a compromise will hopefully be reached to pass some variation of the bill that will provide relief to millions of undocumented immigrants.
As always, we will continue to post new updates on this or that legislation here on our blog.
