What to do if a couple of tenants get divorced?
What to do if a couple of tenants get divorced?
Post with value .. 4th round .. 2 from 3
So what do we do when the couple gets divorced?
(Of course, all that is written is subject to a conversation with your management company and local attorney)
Divorce. Happens everywhere and in the world. Sometimes you as a homeowner are more hurt, sometimes less injured and sometimes you remain without injury.
If you are informed that they are divorcing, you may want to talk to them about what they intend to do in terms of the property…
While re-examining:
1. The agreement
2. The attitude of the spouse to the home
3. The residual income of the spouse who continues to reside in the property (should that be their decision)
The lease
If both spouses sign the contract, then both are obligated to pay a fee, no matter that one has left.
Depending on the situation, it may be necessary to consider making a new lease with the spouse who remains under new or identical conditions.
Access to the property
As long as both spouses are signed on the contract, both have access to the house by law and must not prevent access / entry from one of them
Check the income threshold
When the couple entered, their joint income capability was reviewed.
Now it is necessary to reevaluate the ability to pay the rent of the remaining spouse, and decide whether to make a new contract or replace the tenant.
=====
Did any of you have experience in such a situation?
How did you work? Has the management company ever shared with you?
Have you been able to leave the tenant and avoid the change?

Since my main occupation in the US is divorce agreements and financial agreements and family and business disputes, and I am also an authorized mediator, that's exactly what I do. Solves the conflict between spouses (or business partners) who have separated and then the sale of houses (or businesses) is Off Market
Repairs to post:
If in the divorce agreement it is written that one of the spouses remains at home in most cases the other does not have the right to enter even if the property or contract is registered on it.
In addition, note that the historical credit also varies.
Definitely an interesting topic
At the end of the contract you have to think about how to return the dividend (to whom do you write the check?)
